1. Acceptance of Terms and Acknowledgement
These Terms of Service ("Terms") constitute an End-User License Agreement (EULA) that governs your use of Hushes (the "Licensed Application" or "Service"). By using the Service, you agree to be bound by these Terms.
Important: You acknowledge that these Terms are concluded between You and the Operator (as defined below) only, and not with Apple Inc. ("Apple"). The Operator, not Apple, is solely responsible for the Licensed Application and the content thereof. These Terms do not provide for usage rules for the Licensed Application that are in conflict with the Apple Media Services Terms and Conditions as of the Effective Date.

3. Scope of License
The Operator grants you a limited, non-transferable license to use the Licensed Application on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
4. Description of Service
The Service is an anonymous community app that provides the following features:
- Creating and joining communities
- Real-time chat
- Image and video sharing
- Other features provided by the Service
5. Eligibility
The Service is available to users aged 9 and older.
You may not use the Service if:
- You have previously violated these Terms
- You are associated with antisocial forces
- You may interfere with the operation of the Service
6. Prohibited Activities
When using the Service, you must not engage in the following activities:
- Violating laws or public order and morals
- Criminal activities
- Infringing on the rights of other users or third parties
- Defamation, harassment, or threats
- Posting obscene, violent, or discriminatory content
- Posting child pornography or child abuse-related content
- Spam, advertising, or solicitation
- Collecting or disclosing personal information of other users
- Placing excessive load on the Service's servers or network
- Interfering with the operation of the Service
- Unauthorized access or hacking
- Any other activities deemed inappropriate by us
7. Content Rights
The copyright of content (text, images, videos, etc.) posted to the Service remains with the user who posted it.
However, by posting content to the Service, you grant us a non-exclusive license to use such content for providing, operating, and improving the Service.
8. Content Removal
We may remove content posted by users without prior notice in the following cases:
- Violation of these Terms
- Violation of laws
- Reports from other users or third parties
- Any other cases deemed inappropriate by us
9. Account Suspension or Termination
We may suspend or terminate your account without prior notice if you violate these Terms or if we deem it necessary for operational reasons.
We are not liable for any damages resulting from account suspension or termination.
10. Maintenance and Support
The Operator is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law.
You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
11. Warranty
The Operator is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the Operator's sole responsibility.
12. Product Claims
You acknowledge that the Operator, not Apple, is responsible for addressing any claims of you or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to:
- Product liability claims
- Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
These Terms do not limit the Operator's liability to you beyond what is permitted by applicable law.
13. Intellectual Property Rights
You acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, the Operator, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
14. Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
15. Third Party Terms of Agreement
You must comply with applicable third party terms of agreement when using the Licensed Application. For example, you must not be in violation of your wireless data service agreement or other internet connection service agreement when using the Licensed Application.
16. Third Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
17. Service Changes, Suspension, or Termination
We may change, suspend, or terminate all or part of the Service in the following cases:
- System maintenance or inspection
- Force majeure events such as natural disasters, power outages, or communication failures
- When deemed necessary for operational reasons
We are not liable for any damages resulting from service changes, suspension, or termination.
18. Disclaimer
We are not liable for the following regarding the Service:
- The Service meeting your expectations
- The accuracy, completeness, or usefulness of the Service
- Continuous provision of the Service
- Disputes between users or between users and third parties
- Damages caused by content posted by users
- Damages resulting from use of the Service
19. Indemnification
If you violate these Terms and cause damage to us or third parties, you are responsible for compensating such damages.
20. Subscriptions
The Licensed Application may offer in-app purchases (subscriptions) to access additional features. Subscriptions auto-renew and will automatically renew 24 hours before the end of the billing period unless you cancel through the App Store settings.
To cancel a subscription, please do so through the App Store settings. Deleting your account within the app does not automatically cancel your subscription.
21. Changes to Terms
We may change these Terms as needed. Updated Terms become effective when published in the app or on this website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
22. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes regarding the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
